Court Throws Out Suit Challenging Ibrahim Magu’s Status

Judge Ijeoma Ojukwu of the Federal High court in Abuja has dismissed a suit seeking the removal of the Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Ibrahim Magu.

The judge dismissed the suit on Wednesday.

President Muhammadu Buhari appointed Magu in November 2015 following the sack of Ibrahim Lamorde.

The Nigerian Senate under the leadership of Bukola Saraki rejected to confirm Magu as the Chairman of the agency on two occasions.

In her verdict, Judge Ojukwu said the President has the power to set the duration of the Acting EFCC Chairman.

She said, by that, the law gave the president “the proverbial yam and the knife to do as he pleases” with the appointment of the EFCC chairman.

This is not the first time the court is dismissing a suit challenging Magu’s power. In 2017, a federal high court in Lagos threw out a similar suit instituted by Ebun-Olu Adegboruwa.

Adegboruwa is a lawyer and rights activist.

His suit was seeking an order to restrain Magu from holding the office in an acting capacity.

A Human rights lawyer, Femi Falana had also said the President possesses the power to keep Magu in power as long as he wants.
